13. PARKING
General
13.1. Parking Units can only be used by Occupiers or their visitors while visiting the unit.
13.2. Each Parking Unit shall be used and occupied only for the parking of Vehicles. Only functioning, licenced and roadworthy vehicles shall be parked in the garage.
13.3. Vehicles parked in the Parking Unit shall not exceed the limit of the parking spot or impede access to or hinder the use of the adjacent parking spot or the use of driving lanes.
13.4. Motorcycles are required to park on a parking pad approved by the Board so as to ensure that the floor is not damaged.
13.5. No trailer, boat, canoe, kayak, snowmobile, mechanical toboggan, camper, commercial vehicle, machinery, tires or equipment of any kind shall be parked or stored on any part of the common elements or in any parking Unit, unless authorized by the Board. The Corporation may remove and/or dispose of any such item at the Owner’s risk and cost.
13.6. No Parking Unit shall be used for storage purposes. The only items permitted to be left in a parking spot are vehicles, a single foldable shopping cart and bicycles, the latter two items to be suspended on the bike racks provided within the parking spot. The Corporation may remove and/or dispose of any such item at the Owner’s risk and cost.
13.7. No one shall wash or detail the exterior of their vehicle in the parking garage, other than at the washing bay station.
13.8. Parking is prohibited in any area other than a Parking Unit and specifically prohibited in the following areas:
a) fire zones;
b) traffic lanes;
c) entranceways;
d) delivery and garbage areas; and,
e) roadways.
13.9. Every driver of a vehicle on the property shall comply with all posted signs, directions and speed limits. It is forbidden to leave a vehicle running while unattended or for unnecessary periods of time.
13.10. No person shall place, leave, park or permit to be placed, left or parked in any parking Unit or in any visitor parking spaces any vehicle which, in the opinion of the Property Manager or the Board, may pose a security or safety risk, either caused by its size, the length of its unattended stay, its physical condition or appearance or its potential damage to the property. Upon seventy-two (72) hours written notice from the Corporation, such vehicle shall be removed from the property at the expense of the Owner. If a vehicle is left standing in a parking space or upon the common elements and is unlicenced or unregistered with the Corporation (when and if required), the vehicle may be towed without notice to the Owner and at the Owner’s expense.
13.11. Motorcycles shall be licenced and equipped with the most recent noise and pollution control devices and operated in a manner so as not to disturb any Owners or Occupiers.
13.12. Anyone who parks or uses a vehicle in contravention of these Rules may be fined or may have their vehicle tagged and/or towed from the property at the owner’s sole cost and expense. The Corporation shall not be liable for any damage to same and/or to personal belongings within.
13.13. No vehicle having a propane or natural gas propulsion system shall be driven in the garage or parked in a Parking Unit or on the common elements.
13.14. No oil change, lubrication, service or repairs shall be made to any vehicle parked in any Parking Unit or in the common elements, unless it is of an emergency nature and necessary to allow the vehicle to be removed.
13.15. No one shall plug in or cause to be plugged into any of the garage’s electrical outlet(s) any device such as, but without being limited to, any electric vehicle, trickle charger or in-car block heater, unless authorized in writing by the Corporation or unless an agreement has been reached, in advance and in writing, by the Owner or Occupier and the Corporation.
13.16. No one shall install, or cause or permit to be installed, a structure or enclosure of any kind whatsoever upon, near, above, under or around a Parking Unit.
Garage door and gate
13.17. The Corporation is not responsible for any damage to a vehicle caused by the garage door or any other object or vehicle, in or on the premises. The Corporation may charge back to an Owner any damage to the garage or garage door caused by an Owner, the Occupier(s) of their Unit, their families or anyone for whom the Occupier is responsible.
13.18. No one shall follow another vehicle in or out of the garage without using the garage or gate opener and ensuring that the door is in the fully opened position prior to proceeding.
13.19. No one shall force or maintain open the garage door or the visitor’s gate.
Registration
13.20. Upon request from the Board, all vehicles operated or parked on the Corporation’s property must be registered by providing the make, licence plate number, name of registered owner and Unit associated with same.
13.21. Unless otherwise approved by the Board, no one shall lease a Parking Unit to anyone who is not otherwise the Occupier of a Unit at the Corporation (either by virtue of Ownership of a Unit or by virtue of a lease of a Unit). If a Parking Unit is being leased to the tenant of a Unit, the lease of the parking Unit by a tenant can only be for the duration of, and in association with, the lease of the Residential Unit.
Visitor parking
13.22. The visitors’ parking spaces shall be available only for the use of bona fide visitors of the Owners and their tenants or contractors servicing the Corporation or Units.
13.23. Owners and tenants, members of their households, individuals who ordinarily live with them or long-term Occupiers shall not park their vehicles in any of the visitors’ parking spaces, unless approved in writing by the Corporation.
13.24. The first visitors’ parking space (to the left, entering the garage from outside) is reserved for the use of visitors with physical disabilities. Any vehicle parked in this space without a valid permit may be fined or towed, without notice, at the owner’s risk and cost.
13.25. Visitors shall not park in visitors’ parking, for any part of the day or night, on more than three (3) days within a seven (7) day period and not more than ten (10) days in any given month. These parking restrictions are applicable whether the parking takes place during the day or at night. Any vehicle not registered or which exceeds these parking privileges may be ticketed or towed at the Owner’s risk and expense.
13.26. Requests for visitor parking beyond the parking privileges stated above must be approved in writing in advance by the Board, which may grant extended parking privileges, at its sole discretion. Exceptions may be granted for staff or contractors or non-resident family members providing regular services to Occupiers requiring health-related assistance.
13.27. Visitors shall register their vehicle for the duration of their visit, as provided by policies as set by the Board from time to time. At the time of adoption of these rules:
a) Visitors wishing to park in the visitor parking area must register their vehicle either by calling the number posted in the visitor section of the parking garage or by visiting the website posted in the visitor section of the parking garage.;
b) Vehicles registered after 6:30 am on any given day, will be authorized to park until noon the following day, with in and out privileges subject to availability;
c) Vehicles registered before 6:30 am on any given day will be authorized to park until noon that same day, with in and out privileges, subject to availability;
d) Any parking registration counts towards the use of one day towards the parking limit, regardless of how long the car is parked in the garage.
13.28. Even when a visitor has registered a vehicle, visitors’ parking spaces are on a “first come, first served basis” and cannot be reserved.
13.29. All other rules applicable to parking on owner parking spaces apply to the visitor parking, with required adjustments.
